The Collapse of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – temporarily – to have been contained. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of rocket attacks on Kyiv.

The Pattern of Peace Talks and Military Action

The sequence of conflicting incidents captured the harsh reality of the current period. By day, political struggles are conducted: positive announcements are released from different nations. Considerable effort is allocated on containing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, war remains the primary tool for achieving "resolution".

Nocturnal Warfare

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor projectile deployments from across the border, a capability enabled by timely intelligence. From vantage locations, military aircraft that had been deployed to counter approaching cruise missiles roared overhead – modern combat jets delivered to Ukraine by NATO members.

Soon thereafter, Kyiv's missile defense engaged: multiple launches deployed against a hostile projectile. This was a modern interception technology at work, probably provided by allied countries. Every launch shakes the surroundings, rattling buildings. The moment of terror quickly gives way to resigned acknowledgment: maybe the approaching threat won't hit its mark this time, protecting urban areas from catastrophe and further power outages.

Ongoing Risks

Soon after, a large-caliber weapon engaged a drone somewhere nearby, part of a mobile-fire group – most likely allied-provided weaponry. Regrettably, the bullets missed the opposing UAV – it continued its flight toward its objective.

Periodically, this persisted until dawn. Kyiv awoke to the morning news: seven people killed, destruction and utility failures in many homes as a result of the night's assault. As always, everyone still went about their day – living the war. But those 24 hours encapsulated Ukraine's essential dependence on external assistance – a dependence that European nations are demonstrably unable to replace in the near term.

Unsuccessful Negotiations

The 28-point plan from American leadership generated strong feelings, debate and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and bilateral conferences.

Every new initiative from Washington follows the identical sequence: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They manage the tension but never actually win the battle. This trend will, certainly, persist.

Strategic Calculations

It is convenient to criticize particular leaders of consistently pushing Russian terms. But that does not seem to be the complete picture. US administration functions according to a principle understood by seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The US administration believes that it is impossible to force Russia to abandon the land that it already controls in Ukraine's occupied territories.

The challenge is that while accepting these circumstances, American administration does little to prevent Kremlin actions, through words or deeds, from believing that the situation will not change more in its advantage in the near future.

Divergent Views

Therefore, Moscow is certain that the clock favors them – that Ukraine and its allies are nearing depletion. Their incentive to accept conditions that does not give them the largest achievable advantage is virtually nonexistent. There may be multiple initiatives to achieve ceasefire, but they will continue as long as Russia's leadership remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding lives and land but averting a entire defensive failure until conditions improve in its advantage.

Current Realities

Objectively, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's dual difficulties – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unworkable, so that their attention does not move to homefront challenges. And although their mission will now be significantly challenging after current events, it remains highly unlikely that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Conclusion and Outlook

It took a just a single week to eliminate the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by US administration, pushback by Ukraine and the rest of Europe, along with calming attempts of diplomats, and finally, current information leaks, all did their job.

While new proposals based on old ideas are approaching, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter political attacks from Washington that are founded on Moscow's terms and demonstrate particular unwillingness to alter the situation, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capability to defend against evening bombardments will, for the foreseeable future, primarily depend on continued Western support.
